Impersonating Officer Charges Cleared for Twin Security Guards in Medford
Twin brothers who work as security guards have been cleared of charges they overstepped their duties.
Wednesday, a Jackson County jury found Donald Libby not guilty of two counts of impersonating an officer. Those charges stemmed from an incident which Medford Police allege Libby had ordered a driver and 18-year old passenger out of car and administered limited field sobriety tests.
Private citizens may not administer DUII tests, but they can detain someone for being under the influence before turning them over to police.
Donald’s twin, Jason Libby, faced harassment and 4th degree assault charges in a separate incident that occurred a day earlier but were dropped by the state because of a less than cooperative victim according to Chief Deputy District Attorney.
