D.A. won’t file charges for fatal accident
The Jackson County District Attorney’s Office announced Thursday they will not file charges against a pickup driver who struck and killed a bicyclist.
The accident occurred just after noon on Oct. 25 on Riverside Avenue. 23-year-old Cody James Smith was driving his truck on Riverside when he went to make a right turn and as he had made the maneuver 66-year-old Gary James Tuer, on his electric bicycle, slammed into the truck’s rear passenger side, fell over and struck his head on the concrete.
Tuer was taken by paramedics to Rogue Regional Medical Center where he died later that afternoon. Tuer was not wearing a helmet during the incident.
